Ari Zivotofsky and Alan Jotkowitz (2009) have written an excellent opening to an important conversation between siblings—siblings who are willing to jump into a heated discussion precisely because they love each other, and believe they know the truth will set them free from sin. In this commentary, we question the method of trying to resolve ethical issues by finding analogous cases in ancient writing. The analogy could be faulty or non-existent, as is likely on the three issues Zivotofsky and Jotkowitz (2009) bring up—zygotic personhood, non-conjugal procreation, and doing good with evil? Catholics and Jews hold many moral principles, traditions, and metaphysics in common. We will proceed from these shared principles (e.g. “created in the image and likeness of God”) and then use straightforwardly philosophical arguments that Orthodox Judaism might consider in changing its position.
