The present invention relates to a device for protecting a fishing net and marine organisms, and to a fishing net having the same. The device generates a magnetic field which only sharks can sense in a fishing net such as a stationary net and a long bag set net, thereby blocking the access of sharks and protecting the fishing net and marine organisms including sharks. The device according to the present invention protects a stationary net or a stationary-type net like a long bag set net, and comprises: a buoy (110) floating on water, and informing a position of a fishing net (100)； an electricity generating unit (120) disposed on the buoy (110), and generating electricity； a storage battery module (130) for storing electricity generated from the electricity generating unit (120)； and an electrical current discharging unit (140) disposed on the fishing net (100), and receiving and emitting electricity transferred from the storage battery module (130) to repel sharks or the like from the fishing net (100).본 발명은 정치망이나 낭장망 등의 어망에 상어만이 감지할 수 있는 자기장를 생성함으로써 상어의 접근을 차단하여 어망 및 상어를 포함한 해양생물을 보호할 수 있는 어망 및 해양생물 보호장치 및 이를 구비한 어망에 관한 것이다.본 발명에 따른 어망 및 해양생물 보호장치는 정치망이나 낭장망 등의 정치성(定置性) 어망에 있어서, 물 위에 뜨며 어망(100)의 위치를 알려주는 부표(110)와, 부표(110) 상에 위치하며 전기를 생성하는 전력생성부(120)와, 상기 전력생성부(120)로부터 생산된 전기을 저장하는 축전지모듈(130)과, 상기 어망(100)에 구비되며 어망(100)으로부터 상어류를 리펠링(repelling)할 수 있도록 축전지모듈(120)로부터 전기를 전달받아 방출하는 전류방출부(140)를 포함한다.
