An electrosurgical instrument 200 for freezing biological tissue and subsequently applying microwave energy to the frozen tissue. The instrument comprises a radiating tip 205 mounted at the distal end of a transmission line 204, and a thermal transfer portion 220 which is configured to receive tissue-freezing fluid (i.e. a cryogenic liquid or gas) from a fluid feed and arranged to provide thermal communication between the tissue-freezing fluid and tissue in a treatment zone around the radiating tip 205. By freezing the region around the radiating tip 205, microwave energy can be transmitted through the frozen region with low losses and into tissue surrounding the frozen region. This enables the size of the treatment area to be increased without having to increase the amount of energy delivered. In one arrangement the thermal transfer portion 220 comprises an enclosed reservoir 222 about which the tissue-freezing fluid can be circulated, in another it comprises a nozzle or outlet (314, Fig 3) for directly delivering or spraying the freezing fluid onto tissue. The instrument may additionally be provided in a system comprising a controller for regulating the delivery of freezing-fluid and microwave energy. A method of treating tissue using the instrument is also provided.
