This invention relates to an improved surgical instrument (20) adapted for applying a plurality of surgical fasteners to body tissue, the surgical instrument (20) comprising an anvil (122) a cartridge housing (121) containing a plurality of surgical fasteners, the cartridge housing (121) and anvil (122) being relatively movable between a first spaced apart position and a second position in close approximation with one another a firing mechanism associated with the cartridge housing for ejecting the surgical fasteners from the cartridge housing (121) to be driven against the anvil (122) and a lockout mechanism (180) interacting with the cartridge housing (121) for selective activation and deactivation the lockout mechanism (180) preventing movement of the cartridge housing (121) to its second closed position, but permitting relative reapproximation movement of the cartridge housing (121) and anvil (122), whereby reapproximation provides an indicator that the instrument is not malfunctioning, and the lockout mechanism (180) comprises a lockout lever(181) rotationally mounted on a closure member (28) of the surgical instrument, the lockout lever comprises a distal end (185) and a proximal end (184) with a central section therebetween, the central section being pivotally mounted to the closure member (28) allowing the lockout arm to rotate in a controlled manner.
