PROBLEM TO BE SOLVED: To provide a staple assembly which permits leakage passing through tissue around a staple legs of a staple assembly to be reduced.SOLUTION: In the surgical staple assembly, a staple has a back span and a pair of legs extending from the back span. Each of the legs terminates at tissue penetration tips. The staple has a first compression member having a first opening portion to receive the leg of the staple and a second compression member having a second opening portion to receive the leg of the staple.
