PROBLEM TO BE SOLVED: To provide a surgical staple structured so as to adapt to varying compression of tissue.SOLUTION: The surgical staple comprises a first leg, a second leg and a back span. The back span has a first side extending from the first leg and a second side extending from the second leg. The first and second sides are arranged, spaced apart so as to create a gap between them.
