PROBLEM TO BE SOLVED: To provide a state determining device and state determining method for precisely detecting the conflict state of a subject.SOLUTION: An operation state determining section 7 determines the state of the subject, based on the accuracy of an operation input time by an operation signal input device 2, which corresponds to the state change of a face image between an eye-opening state and an eye-closing state. By the configuration, the subject tries to hold an operation input though being efficiently guided to a sleepiness state and feeling sleepiness, so that the conflict state is generated.
